Hidden Services & Site Utilities
Existing coatings and surfaces may conceal electrical cables, conduits, pipes, or other services that are not reasonably discoverable before works begin.
Unless clearly identified and marked by the client in writing beforehand, we are not responsible for damage to hidden or undisclosed services during preparation, coating removal, grinding, or related works.
Where clients provide power points or other site services for use during works, we rely on those services in good faith and cannot verify their condition. To the extent permitted by law, we are not liable for failure of or damage to faulty or defective client-supplied outlets, fittings, RCDs/breakers, or services arising from ordinary use, including trips, the cost of replacing breakers or safety switches, or claims that electrical appliances or equipment were damaged.
Dust, Odour & Site Conditions
Preparation and coating works produce dust, noise, fumes, and odour as a normal part of the process. Dust may enter adjoining indoor areas despite reasonable care.
Unless specifically included in the quote, clients are responsible for protecting indoor areas and for any cleaning arising from dust. We are not obliged to hose down the house or engage cleaners, and to the extent permitted by law we are not liable for cleaner fees or dust-related cleaning claims.
Product odours are inherent to epoxy and related systems. Clients who are sensitive to fumes should arrange ventilation or temporary absence. To the extent permitted by law, we are not liable for alternative accommodation or similar costs arising from dust, odour, fumes, or noise.
Warranty & Performance
Subject to Australian Consumer Law, we provide a 5-year limited workmanship warranty from Delivery for workmanship and advertised specifications where the warranty conditions are met. Full Limited Workmanship Warranty terms appear on each quote.
Normal wear and tear, misuse, neglect, lack of maintenance, or external damage are not covered. This includes coating failure caused by chemicals, oils, fuels, or solvents left on the surface, ongoing oil/fluid leaks that are not cleaned off, or damage from high-pressure washing (including Gerni or similar pressure cleaners).
Limitation of Liability
To the maximum extent permitted by law, DWD Epoxy & Concrete Solutions is not liable for indirect or consequential losses (including alternative accommodation and cleaning costs), damage to hidden or undisclosed services, failure of client-supplied site services and fittings used in the ordinary course of works, RCD/breaker trips or related appliance claims, or dust/odour/noise-related inconvenience claims. Nothing in these terms excludes Non-Excluded Guarantees under the Australian Consumer Law.
